Welcome to EVERGY, the trading name of Lighting and Mains Power Solutions. These Terms and Conditions ("Terms") apply to your use of our website, www.evergy.co.uk, and govern all orders and purchases made through the platform. By using our website, you agree to comply with and be bound by these Terms, in accordance with UK consumer law. 

 

 1. Introduction

1.1 These Terms and Conditions apply to all users of the EVERGY website, including customers, browsers, vendors, and content contributors.   

1.2 By accessing our website, you agree to these Terms. If you do not agree with any part, you should refrain from using our website.   

1.3 Lighting and Mains Power Solutions is a registered entity in the United Kingdom, trading under the name EVERGY. All contracts and purchases made via our website are governed by these Terms and UK law.

2.1 Lighting and Mains Power Solutions, trading as EVERGY ("we", "us", "our"), is registered in the UK under company number 05577627, with our registered office located at Unit 10 Drakes Drive, Crendon Industrial Park, Long Crendon, Bucks HP18 9FE 
 

 3. Eligibility to Purchase

3.1 To use our website or purchase products, you must be at least 18 years of age and legally capable of entering into binding contracts.   

3.2 By placing an order, you represent that all information provided is accurate, and you have the authority to use the payment method selected.   

 

4. Products and Pricing

4.1 We strive to provide accurate descriptions and images of our products. However, colours and images may vary slightly from the actual product.   

4.2 All prices on our website are displayed in GBP (£) and have the option to include or exclude VAT. Prices are subject to change without notice.   

4.3 In the event of a pricing error, we reserve the right to cancel or refuse any orders placed at the incorrect price. If this happens, we will notify you and give you the option to purchase at the correct price. 

4.4 Installation is not included within our pricing.  

4.5 Carriage charges are determined at checkout. If there is an error on a carriage charge, we hold the right to not send the goods until the new carriage cost has been paid for. 

 

5. Orders and Acceptance

5.1 Your order is considered an offer to purchase products from us. A contract between you and EVERGY is formed only when we confirm the order.   

5.2 We reserve the right to refuse or cancel any order for any reason, including product availability, pricing errors, or suspected fraud.   

5.3 Once an order is placed and accepted, you are responsible for ensuring all details (such as product choices and delivery addresses) are accurate.   

 

6. Payment

6.1 Payments must be made in full at the checkout point before orders are processed. We accept major credit and debit cards, apple pay, and other payment gateways as specified on our website.   

6.2 We use secure payment processing services via a third party called Stripe. Please refer to their T&C’s for more detail - EVERGY does not store your payment details.   

6.3 In the event of non-payment, we reserve the right to withhold delivery or cancel the order.

7. Delivery and Risk

7.1 We deliver to addresses within the United Kingdom and other selected regions as indicated on our website.   

7.2 Delivery times are estimates and not guaranteed. We are not liable for delays caused by circumstances beyond our control (e.g., courier issues, strikes, extreme weather).   

7.3 The risk of loss or damage to the goods passes to you upon delivery. Ownership of the products will transfer to you once payment is received in full.   

7.4 If your goods are lost or damaged in transit, please contact us immediately so we can assist you in resolving the issue. 

7.5 Failure to accept delivery, except on legal specific grounds, is a breach of contract. 

 

8. Your Right to Cancel (UK Consumer Contracts Regulations 2013)

8.1 Under UK law, you have the right to cancel your order within 14 days from the date of receiving the goods, without providing a reason.   

8.2 To exercise your right to cancel, you must notify us by email (info@evergy.co.uk) or by phone on 01844 393939 within 14 days of receipt.   

8.3 You must return the products in their original packaging, unused, and in saleable condition within 14 days of notifying us of your cancellation.   

8.4 You are responsible for the cost of returning the items unless the products are faulty or not as described.   

8.5 Upon receipt of the returned goods and inspection, we will process your refund, including the initial delivery cost (standard delivery only), within 14 days. 

 

9. Returns and Refunds

9.1 In addition to your right to cancel, EVERGY offers a return policy of 14 days for faulty or defective items.   

9.2 If you receive a damaged or faulty product, please contact us immediately with details and photographs, if applicable.   

9.3 If the product is deemed faulty, we will offer a replacement or full refund, including any reasonable return shipping costs.   

9.4 Refunds will be processed using the original payment method and may take several business days to appear in your account. 

9.5 If the product if faulty and is within the manufactures warranty period, we will review and replace as per conditions with the supplier.

10. Warranties

10.1 All products sold on our website comply with UK consumer rights. If your product is faulty, not as described, or doesn’t meet its intended purpose, you may be entitled to a replacement or refund under the Consumer Rights Act 2015.   

10.2 Please note that the manufactures warranty does not cover damage caused by misuse, neglect, or normal wear and tear. Please see individual manufactures website for their warranty guidance.  

 

11. Intellectual Property

11.1 All content on the EVERGY website, including logos, text, graphics, images, and product designs, are the intellectual property of Lighting and Mains Power Solutions or its licensors.   

11.2 You may not copy, reproduce, distribute, or create derivative works from any content on our website without our express written permission. 

 

12. Limitation of Liability

12.1 We will not be liable for any indirect, consequential, or incidental losses or damages arising from your use of our website, except where such liability cannot be excluded under UK law.   

12.2 Our maximum liability to you for any claim related to your order will be limited to the value of the products purchased.

16.1 Each discount code or coupon is intended for one-time use per customer or company, regardless of the number of employees signing up, unless stated otherwise. 

16.2 The creation of multiple accounts to redeem discount codes or coupons multiple times is strictly prohibited. 

16.3 Any orders suspected of violating this policy may be cancelled at the discretion of Lighting and Mains Power Solutions, trading as EVERGY.
